About Us and End User License Agreement

Zhuoyun Information Technology Co., Ltd is the developer of the application and related services that you are about to download, install, access, and/or use, whether through a mobile platform or through our website.

This End User License Agreement constitutes a legal agreement between you and Zhuoyun Information Technology Co., Ltd. It contains important information regarding your rights and obligations in connection with your use of the application and related services.

Your use of the applications and related services is also governed by our policies, which are incorporated by reference into this End User License Agreement.

By installing, accessing, or using our applications or related services, you confirm that you are the owner or authorized user of the device, are at least 13 years of age (or the minimum age required by applicable law, which is 16 where applicable), and have the legal capacity to enter into this Agreement. If you are at least 13 years of age but under 18 years of age, you hereby confirm that your representative has reviewed and agreed to the terms and conditions of this End User License Agreement and has permitted you to access and/or use our applications and related services.

License and Restrictions

We hereby grant you a non-exclusive, personal, limited, revocable, and non-transferable license to access, download, and use the application solely on your device, provided that you agree to comply with all terms and conditions of this End User License Agreement (EULA). This includes your compliance with the terms and conditions relating to the copyrights of our music applications, as set forth in the "Copyright License – Music Applications" section below. Please note that the application is licensed to you, not sold to you. We own all rights, title, and interest in the application and reserve all rights not expressly granted to you in this EULA.

You shall not sell, resell, distribute, redistribute, lease, rent, sublicense, transfer, copy (except for one backup copy), or otherwise grant any third party any rights to the application. Unless expressly permitted by the applicable mobile platform terms or authorized by us, you shall not distribute the application over a network, or allow it to be downloaded or used on multiple devices simultaneously.

You shall not use any automated or manual device or program to interfere with the proper operation of the application, except for the purpose of removing the application from your device.

You shall not decompile, disassemble, reverse engineer, or create derivative works of the application or any part thereof. All modifications or enhancements to the application shall be owned by us.

You shall not copy or use any content, in whole or in part, for any artificial intelligence purposes. Specifically, you shall not use any content, in whole or in part, to develop, create, direct, train, improve, or enhance any deep learning, machine learning, or other artificial intelligence applications, including any convolutional neural networks, whether for commercial or non-commercial purposes. You shall not capture game screenshots, record game videos, or use text and data through web crawling, screen scraping, or similar data collection methods for the purpose of creating datasets for training AI models, model validation, or testing.

Privacy

Your use of Zhuoyun Information Technology Co., Ltd's applications is subject to our Privacy Policy, which is incorporated by reference into this End User License Agreement (EULA).

Content and User Conduct

You must comply with all applicable laws in your country and in any other location where you download, install, access, or use our applications and/or services. If any applicable law restricts or prohibits you from using our services or any part thereof (such as certain features), you must comply with such legal restrictions.

You understand and agree that all content shared through our services, whether publicly shared, uploaded, posted on third-party platforms/networks, or privately transmitted, is the sole responsibility of the sender. This means that you, and not we, are fully responsible for all content that you upload, transmit, or otherwise make available. Furthermore, you are obligated to ensure that such content does not violate this End User License Agreement or the terms or policies of the third-party platforms/networks on which you share, upload, or post such content.

We do not control the content posted by other users through our services and therefore do not guarantee the accuracy, completeness, or quality of such content. You understand that when using our services, you may encounter content that you find offensive, indecent, or objectionable. Under no circumstances shall we be liable for any content, including but not limited to errors or omissions in any content, or any loss or damage arising from content posted, emailed, transmitted, or otherwise made available through our services.

We reserve the right to remove content uploaded to the services if, in our sole discretion, such content is inappropriate or may harm our reputation or the services. You acknowledge that we may monitor user-contributed content, but we are under no obligation to do so.

Intellectual Property

You acknowledge that, except for specific rights in content contributed by you or other service users, all intellectual property rights relating to our services are owned by or licensed to us. This includes, but is not limited to, all trademarks, trade dress, designs, texts, images, photographs, illustrations, audio or video clips, artwork, graphic materials, code, content, agreements, software, and documentation associated with your use of our services. Intellectual property rights are protected by relevant international, EU, US, and other national copyright laws, trademark laws, patent laws, trade dress laws, and other intellectual property-related laws.

Your right to access and use our services is strictly limited to the express license granted in the "License and Restrictions" section above and is subject to all terms of this End User License Agreement. All rights not expressly granted herein are reserved by us and our licensors.

You further acknowledge and agree that, except for the limited license expressly granted in this End User License Agreement (EULA), you have no other rights, property, or ownership in any of our services (including but not limited to your account and any data associated with your account). Without our prior written consent, you shall not copy, distribute, make available to the public, or create any derivative works based on our applications or related services or any part thereof.

Export Control and Legal Compliance

Your downloading, use, access, or other export or re-export of our applications and services must comply with all relevant international, United Nations, US, or EU sales, export, or import restrictions and regulations, and you agree to comply with such restrictions and regulations. You represent and warrant that: (i) you are not located in a country or region that is subject to a US government embargo or that has been designated by the US government as a "state sponsor of terrorism"; (ii) you are not listed on any prohibited or restricted list, such as the US Treasury Department's Specially Designated Nationals List, the US Commerce Department's Denied Persons List or Entity List, or the EU's Consolidated Sanctions List; and (iii) you comply with relevant UN and EU sanctions and embargoes.
